Legal Duties of Workers
A short presentation providing training in the legal duties of ‘workers’ under the Work Health and Safety Act 2011. This presentation has been specifically developed for the mining industry and uses actual mining examples.
The presentation is designed to inform workers of their legal obligations under the Work Health and Safety Act 2011 and, encourage individual workers to proactively manage risks in their workplace. It is a suitable inclusion for whole of workforce training days etc.
Course Content Includes:
· Section 14 WHSA – Prevention of the transfer of legal duties.
· Section 16 WHSA – Responsibility in relation to areas you can ‘influence and control’.
· Section 19 WHSA ‘Primary Duty of Care’ – ‘Ensure, so far as is Reasonably Practicable’.
· Section 27 WHSA ‘Duties of Officers’ - ‘Exercise Due Diligence’.
· Section 28 WHSA ‘Duties of Workers’ - ‘Take Reasonable Care’, ‘Comply’ & ‘Co-operate’.
· Section 31 ‘Gross Negligence’ and ‘Reckless Conduct’.
· Industrial and Criminal ‘Manslaughter’.
· Managing issues in accordance with the legislation.
· The ‘Efficiency vs Thoroughness Trade Off’.
· Analysis of Coal Mine Fatalities since the Gretley Disaster & lessons to be learnt.
Learning Objectives Include:
· Understand their personal legal duties under the Work Health and Safety Act 2011.
· Take reasonable care, comply, cooperate, and avoid reckless conduct or gross negligence.
· Proactively identify and control hazards and risks in the workplace & apply the legislation.
